Agreement to Terms

By accessing or using any services, data, or content provided by Deaf Bible Society, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Deaf Bible Society ("DBS," "we," "us," or "our") governing your access to and use of our website, sign language data, APIs, applications, and all related services (collectively, the "Services").

By accessing or using our Services, you represent and warrant that you:

  • Are at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Are not prohibited from using the Services under applicable law
  • Will comply with all terms and conditions set forth herein

If you are accessing the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

2. Proprietary Data Rights

Critical Notice

All sign language data, translation progress information, project data, analytics, reports, and any other information provided through our Services is the exclusive property of Deaf Bible Society and is protected by intellectual property laws and international treaties.

2.1 Data Ownership

All data, content, and information accessible through our Services, including but not limited to:

  • Sign language translation progress data and metrics
  • Project information, timelines, and status reports
  • Language statistics, demographic data, and analytics
  • Partner and organization information
  • Predictive models, algorithms, and derived insights
  • Database structures, APIs, and technical implementations

is owned exclusively by Deaf Bible Society or its licensors and is protected by copyright, trade secret, and other intellectual property rights.

2.2 Restrictions on Use

Without the prior explicit written permission of Deaf Bible Society, you are strictly prohibited from:

  • Selling or commercializing any data, content, or information obtained from our Services
  • Copying, reproducing, or duplicating our data in any form or medium
  • Transferring, distributing, or sharing data with any third party
  • Creating derivative works based on our data or content
  • Sublicensing or granting access to our data to others
  • Using data for competitive purposes or to develop competing products or services
  • Scraping, harvesting, or bulk downloading data through automated means
  • Removing, altering, or obscuring any proprietary notices or attributions

2.3 Written Permission Requirements

  • The intended purpose and manner of use

3. Prohibited Uses

In addition to the data restrictions above, you agree not to use our Services to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon or violate the intellectual property rights of others
  • Transmit any malware, viruses, or malicious code

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof, are the exclusive property of Deaf Bible Society or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 Trademarks

"Deaf Bible Society," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Deaf Bible Society. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

4.3 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your personal, non-commercial use. This license does not include any right to:

  • Modify or copy the materials except as expressly permitted
  • Use the materials for any commercial purpose
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Attempt to reverse engineer any software contained in the Services

5. User Accounts

6. API & Data Access

6.1 API Usage

If you are granted access to our APIs, such access is subject to additional terms and rate limitations. You agree to:

  • Use API keys only for authorized purposes
  • Not share, transfer, or expose API credentials to unauthorized parties
  • Comply with all rate limits and usage quotas
  • Not attempt to circumvent any access controls or limitations
  • Immediately notify us if your API credentials are compromised

6.2 Data Accuracy

While we strive to ensure the accuracy of data provided through our Services, we make no warranties or representations regarding the completeness, accuracy, reliability, suitability, or availability of any data. You acknowledge that data may contain errors or inaccuracies and agree to use it at your own risk.

7. Third-Party Services

Our Services may contain links to third-party websites, services, or resources that are not owned or controlled by Deaf Bible Society. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Deaf Bible Society, its subsidiaries, affiliates, and licensors do not warrant that:

  • The Services will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Services are free of viruses or other harmful components
  • The results of using the Services will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEAF BIBLE SOCIETY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid us, if any, in the past twelve (12) months.

10. Indemnification

You agree to defend, indemnify, and hold harmless Deaf Bible Society, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Services
  • Your violation of any rights of a third party
  • Any content you submit, post, or transmit through the Services

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You agree that upon termination, you will:

  • Immediately cease all use of the Services
  • Delete or destroy any data or materials obtained from the Services
  • Not retain any copies of proprietary data or content

12. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction and venue of such courts.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Deaf Bible Society.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Deaf Bible Society regarding the use of the Services, superseding any prior agreements between you and us relating to the Services.
